'Whether In Berth Or Not' — clause allowing NOR to be tendered before the vessel reaches the berth.
Regulatory detail & full definition
WIBON ('Whether In Berth Or Not') clause permitting the master to tender notice of readiness on arrival at the customary anchorage or waiting place even if no berth is available. The clause is critical in congested ports because, without it, NOR cannot validly be tendered until the vessel is alongside, delaying laytime commencement and exposing the owner to lost time. BIMCO's standard library publishes the clause and the related WIPON, WIFPON, and WCCON variants for fog-, port-, and customs-clearance scenarios. Reported cases turn on whether the vessel was genuinely ready to load or discharge when NOR was tendered.
